This website and store (the "Site") is operated by SBSCOMMERCE LLC ("Pawkk," "we," "us," or "our"). We operate this Site, including all related information, content, features, tools, products and services made available through it (collectively, the "Services"), in order to provide you, the customer, with a curated shopping experience. Pawkk is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service ("Terms") govern your access to and use of the Services. Please read these Terms carefully. By accessing or using the Services, placing an order, or otherwise interacting with us, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not access or use the Services.
If there is a conflict between these Terms and our Privacy Policy with respect to the collection, processing, and disclosure of your personal information, the Privacy Policy controls.
Eligibility
The Services are intended for use by individuals who are at least the age of majority in their jurisdiction of residence and who can form a legally binding contract. By using the Services, you represent and warrant that you meet these requirements and that the information you provide to us is accurate, current, and complete. The Services are not intended for use by children, and we do not knowingly permit individuals under the age of majority to register accounts or transact with us.
The Services
We sell pet products and related merchandise as physical goods that are shipped to the address you provide at checkout. We reserve the right, at any time and without prior notice, to modify, suspend, or discontinue any aspect of the Services, including products, pricing, content, or features. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
Accounts
You may be able to create an account to use certain features of the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We highly recommend that you do not share your username, password, or other access details with anyone else. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
Products, Pricing, and Availability
We make reasonable efforts to display product descriptions, images, and pricing accurately. However, we do not warrant that product descriptions, colors, images, pricing, or other content on the Services are accurate, complete, reliable, current, or error-free. Products are subject to availability, and we may limit or cancel quantities purchased per person, per household, or per order.
All prices are listed and charged in U.S. dollars (USD) and are subject to change without notice. In the event a product is listed at an incorrect price or with incorrect information due to a typographical or other error, we reserve the right to refuse or cancel any order placed for that product, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged and we cancel the order, we will issue a refund in the amount of the charge.
Orders and Acceptance
Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right, in our sole discretion, to accept, refuse, limit, or cancel any order for any reason, including suspected fraud, payment authorization failure, errors in pricing or product information, or violations of these Terms. If we cancel an order after your payment method has been charged, we will issue a refund for the affected items.
Payment
By providing a payment method, you represent and warrant that you are authorized to use it and you authorize us, through our payment providers, to charge the full amount of your order to that payment method. We accept major credit and debit cards (including Visa, Mastercard, American Express, and Discover) and any additional payment options displayed at checkout, such as PayPal, depending on availability. Depending on availability at checkout, payments are processed securely through trusted third-party payment providers such as Stripe, Shopify Payments, or PayPal. To provide a secure payment experience and to detect and prevent fraud, transactions may be subject to 3D Secure authentication and other verification measures.
All charges are processed in U.S. dollars (USD). Charges from us will appear on your bank or card statement as "PAWKK," which references SBSCOMMERCE LLC, the operator of Pawkk. If you do not recognize a charge, please contact us before disputing it (see "Chargebacks and Disputes" below).
All payment transactions are encrypted and processed through PCI-DSS-compliant payment providers. We do not collect or store your full payment card details on our own systems; this information is handled directly by our payment providers in accordance with their security standards and privacy policies. If your payment cannot be charged or authorized, or if a charge is later reversed, we may cancel or suspend your order. You are responsible for any applicable taxes, duties, or charges associated with your purchase that are not collected by us at checkout.
Chargebacks and Disputes
If you have a question or concern about a charge, please contact us first at help@pawkk.com before filing a chargeback or payment dispute with your bank or card issuer. Most issues — an unrecognized charge, a delayed or missing delivery, or a damaged or incorrect item — can be resolved quickly and directly by our support team, often faster than the formal dispute process.
Filing a chargeback for a charge you authorized, or without first giving us a reasonable opportunity to resolve the issue, may be treated as a fraudulent or invalid dispute. Where we hold evidence that an order was placed, authorized, and fulfilled — or that a refund or replacement was already offered or provided — we reserve the right to challenge the dispute and submit that evidence to the card network. Nothing in this section limits any rights you may have under applicable law or your card network's rules.
Electronic Communications and Text Messages
By using the Services, creating an account, or providing your contact information, you consent to receive communications from us electronically, including by email, text message, or notices posted on the Services. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
If you provide your phone number and opt in to receive text messages, you consent to receive recurring automated marketing and transactional text messages from us at that number, including messages sent using an automatic telephone dialing system. Consent to receive marketing text messages is not a condition of any purchase. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP to any message, and you can reply HELP for assistance. We are not responsible for any delayed or undelivered messages, as delivery depends on your mobile carrier.
Shipping and Delivery
We currently ship to addresses within the United States only. Orders are typically processed within 1 to 3 business days, and estimated delivery is typically 5 to 12 business days from the date the order is processed, unless otherwise stated on the product page or at checkout. Combining processing and transit, most customers receive their order within approximately 6 to 15 business days from the date the order is placed. Delivery timeframes are estimates only and are not guaranteed. Shipping times may be affected by factors outside our control, including customs processing, carrier delays, weather, and high-demand periods. Returns, Refunds, and Cancellations
We accept returns within 14 days of delivery, subject to the conditions set out in our Refund & Returns Policy, which forms part of these Terms. Certain items may be non-returnable as described in that policy or on the applicable product page. Refunds, when approved, are issued to the original payment method. Promotions and Discounts
From time to time we may offer promotions, discount codes, or other offers. Such offers are subject to any additional terms stated at the time of the offer, may be modified or withdrawn at any time, cannot be combined unless expressly stated, and have no cash value.
Prohibited Uses
You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Services. Without limitation, you agree not to:
- violate any applicable law or regulation;
- infringe the intellectual property or other rights of any party;
- submit false, misleading, or fraudulent information;
- attempt to gain unauthorized access to the Services, other accounts, or our systems;
- introduce viruses, malware, or other harmful code;
- use automated means to scrape, harvest, or collect data from the Services without our consent; or
- interfere with the security or proper functioning of the Services.
We reserve the right to terminate your access for violating any of the foregoing.
Intellectual Property
The Services and all content and materials available through them, including text, graphics, logos, images, product descriptions, and the Pawkk name and branding, are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Services without our prior written permission.
User Content and Reviews
If you submit reviews, comments, or other content through the Services, you grant us a non-exclusive, royalty-free, worldwide, perpetual, and transferable license to use, reproduce, display, and distribute that content in connection with the Services and our business. You represent that any content you submit is accurate, does not violate these Terms, and does not infringe the rights of any third party. We reserve the right, but have no obligation, to monitor, edit, or remove any content at our discretion.
Third Party Websites and Services
The Services may contain links to websites or services operated by third parties, and rely on third-party providers including Shopify and payment providers. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party websites and services is at your own risk and subject to their terms and policies.
Disclaimer of Warranties
The Services and all products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected. Product descriptions and any guidance provided through the Services are for general informational purposes only and do not constitute veterinary, medical, or professional advice. You should consult a qualified veterinarian regarding the health, care, and suitability of any product for your pet.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall SBSCOMMERCE LLC, its officers, members, employees, agents, or suppliers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services or any products purchased, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. To the fullest extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to the Services or any product shall not exceed the amount you paid to us for the product or order giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless SBSCOMMERCE LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Termination
We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if we believe you have violated these Terms or for any other reason in our sole discretion. Upon termination, your right to use the Services will immediately cease. The provisions of these Terms that by their nature should survive termination — including, without limitation, the sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
Force Majeure
We will not be liable or responsible for any failure to perform, or delay in performing, any of our obligations that is caused by events outside our reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, governmental actions, labor disputes, supplier or carrier failures, shipping or customs delays, and power or internet outages.
Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. You agree that any dispute not otherwise resolved shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, and you consent to personal jurisdiction in those courts, except where prohibited by applicable law. Nothing in this section limits any rights you may have under the mandatory consumer protection laws of your place of residence.

Assignment. We may assign or transfer these Terms, in whole or in part, at any time without notice to you. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent.
No Waiver. Our failure to enforce any provision of these Terms will not constitute a waiver of that or any other provision.
No Agency. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.
Headings. Section headings are provided for convenience only and do not affect the interpretation of these Terms.
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Entire Agreement
These Terms, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy, and any other policies or notices posted on the Services, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.
Changes to These Terms
We may update these Terms from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Terms on this website, update the "Last updated" date above and provide notice as required by applicable law. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms.
